1. Who we are
JanaJoy is operated by Sojana Botha, trading as JanaJoy ("we", "us", "the seller"). When you create an account or buy a subscription, your contract is with Sojana Botha, trading as JanaJoy.
JanaJoy is an AI-assisted service that helps teachers create curriculum-aligned lesson plans, worksheets, tests, classroom decor and related teaching resources (the "Service").
2. Acceptance of these terms
By creating an account or continuing to use the Service, you agree to these Terms & Conditions. If you do not agree, please do not use the Service. You confirm that you are of legal age to enter into this agreement, and if you use the Service on behalf of a school or organisation, that you have authority to bind that organisation.
3. Your account
You must keep your login credentials confidential and are responsible for all activity under your account. You agree to provide accurate information and to keep it up to date.
4. Licence and acceptable use
We grant you a limited, non-exclusive, non-transferable right to use the Service within the limits of your selected plan. You must not misuse the Service, including:
- using it for anything unlawful, fraudulent or deceptive, or to send spam;
- infringing anyone's intellectual property or privacy rights;
- interfering with the Service's security — no malware, probing, scraping or circumventing plan limits;
- reverse engineering the Service, or reselling or redistributing access to it;
- generating illegal content, hate speech, deepfakes, malware instructions, or attempting to bypass safety controls.
5. AI-generated content
The Service uses generative AI. AI outputs may be inaccurate, incomplete or unsuitable for your context. You are responsible for your prompts, for having the rights to any content you input, for reviewing and verifying outputs before classroom use, and for how you use them. AI output is not a substitute for regulated professional advice.
You retain the rights to the resources you create for your own teaching use. You grant us a limited licence to host and process your content solely to provide the Service. We may remove or restrict content, filter or refuse outputs, and suspend accounts that violate these terms, including for repeated intellectual-property infringement. Rights holders may contact us to request a takedown.
6. Intellectual property
We own the Service and its intellectual property, including the software, documentation, design and JanaJoy branding. These terms do not transfer any of that ownership to you.
7. Payments and subscriptions
Paid plans are billed monthly and renew automatically until cancelled. Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns. Payment, billing, tax, cancellation and refund mechanics are governed by Paddle's Buyer Terms. See also our Refund Policy.
8. Service availability
We work hard to keep the Service reliable, but we do not guarantee uninterrupted or error-free performance. Features may change over time as the Service improves.
9. Suspension and termination
We may suspend or terminate your access for material breach of these terms, non-payment, security or fraud risk, or repeated or serious violations. When access ends, your right to use the Service stops; you may contact us within 30 days to request an export of your saved resources, after which your data may be deleted as described in our Privacy Notice.
10. Liability
The Service is provided "as is" and we disclaim implied warranties (including merchantability and fitness for a particular purpose) to the fullest extent permitted by law. We are not liable for indirect, consequential or special damages such as loss of profits, data or goodwill. Our aggregate liability is capped at the fees you paid in the 12 months before the claim. Nothing in these terms excludes liability for fraud, death or personal injury where the law does not allow it.
11. General
These terms are governed by the laws of South Africa, and disputes will be heard in the courts of South Africa. You may not transfer your account without our consent; we may assign these terms in connection with a merger or acquisition. We are not responsible for delays caused by events beyond our reasonable control. If we update these terms, we will post the new version here and continued use of the Service means you accept it.
